Terms of use

01Purpose and acceptance

These terms of use (the "Terms") govern access to and use of the AllFight mobile app and the AllFight website (together, the "Services").

By creating an account, downloading the app or using the Services, you fully accept these Terms and the privacy policy. If you do not accept them, you must not use the Services.

These Terms are a translation of the French version. In the event of any discrepancy, the French version prevails.

02Publisher of the Services

The Services are published by Artefix, based in Belgium ("AllFight", "we", "us").

Website hosting: Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. App hosting: Google Cloud / Firebase, with the database located in the European Union.

03Access conditions

• If you are under 16, you must have your parents' or legal guardian's consent to use the Services.
• You must have the legal capacity to accept these Terms.
• Accessing the Services requires a compatible device and an internet connection, at your own cost.
• The Services are free. AllFight currently offers no subscription or in-app purchase. If paid features are ever introduced, they will be subject to specific terms brought to your attention beforehand.

04Your account

• You agree to provide accurate information and keep it up to date.
• Your account is personal and may not be transferred, sold, lent or shared. Only one account per person is allowed.
• You are solely responsible for keeping your credentials confidential and for all activity on your account. Let us know immediately of any unauthorized use.
• Your username must not impersonate anyone (fighter, organization, other user), be offensive or discriminatory, or infringe anyone's rights. We may change or remove a non-compliant username.
• You can delete your account at any time from the app.

05Picks: a free game with no money

Picks are an entirely free entertainment game. They are in no way a game of chance, a bet or a sports betting service within the meaning of the Belgian Gaming Act of 7 May 1999.

• No stake, deposit or payment is required to take part.
• Points earned have no monetary value. They cannot be bought, sold, exchanged, converted into money, goods or services, or transferred to another account.
• AllFight pays out no cash prizes.
• The points scale, calculation rules, leaderboards and seasons may be changed at any time, in particular to improve the game or fix an error.
• Picks close when the fight starts. Points are calculated based on official results as recorded in our systems. In the event of a cancellation, postponement, opponent change, changed result (no contest, disqualification, overturned decision) or data error, AllFight may cancel, recalculate or correct the points concerned.
• Any attempt to cheat (multiple accounts, automation, exploiting a bug, manipulating leaderboards) will result in the points being cancelled and may lead to the account being suspended or deleted.
• In the event of a disagreement over a points calculation, AllFight's decision, made in good faith after checking, is final to the extent permitted by law.
• Picks are not betting advice. If you bet elsewhere, do so responsibly and only with licensed operators.

06Private leagues and rewards

• You can create a private league and invite other users. A league's creator is responsible for its name, description, image and moderation.
• The creator may mention a reward for information purposes only. That reward is organized exclusively between league members, outside the Services. AllFight does not organize, fund, guarantee or deliver any reward, and accepts no liability for it: its existence, value, delivery, taxation or disputes between members.
• Using a league to organize money stakes, bets, a lottery or any game of chance is strictly prohibited. AllFight may delete any league breaking this rule without notice.

07MMA information and trademarks

• Sports information (schedule, fights, results, stats, odds, fighter profiles, news) is provided for information purposes only. It comes partly from third-party sources and may be incomplete, inaccurate or delayed. Times may change. Check official sources before making any decision.
• Any odds displayed are indicative and are neither a betting offer nor an incentive to bet.
• AllFight is an independent service. It is not affiliated with any MMA organization (UFC, PFL, ARES, KSW, Bellator or other), nor sponsored, endorsed or operated by them.
• The names, logos, trademarks and images of organizations and fighters belong to their respective owners. They are used solely for identification and information purposes. Any rights holder can request their removal at the address given in the "Report content" section.

08Your content

You remain the owner of the content you post in the Services (username, bio, photo, league name and image, messages, etc.).

By posting it, you grant AllFight a non-exclusive, royalty-free, worldwide license for as long as it is online, to host, reproduce, technically adapt (format, size) and display it, solely to operate and promote the Services. This license ends when the content or your account is deleted, subject to temporary technical copies.

You guarantee that you hold all necessary rights to your content, including the image rights of the people shown, and that it infringes no third-party right and no law.

AllFight is not required to review content before it is posted, but may remove, hide or refuse any content that breaches these Terms or the law.

09Rules of conduct

By using the Services, you agree not to:

• post unlawful, hateful, discriminatory, violent, sexual, defamatory, abusive or harassing content;
• impersonate a person, fighter or organization;
• post other people's personal data without their consent;
• advertise, spam or engage in unauthorized commercial solicitation;
• access or attempt to access AllFight's or other users' accounts, data or systems without authorization;
• extract the Services' data at scale (scraping, bots, crawlers) without written permission;
• decompile, disassemble, copy or modify the app, except to the extent permitted by law;
• disrupt the Services, in particular by introducing viruses or overloading the servers;
• circumvent security measures or technical limits;
• use the Services for unlawful purposes or in breach of these Terms.

10Report content

If you come across content that is unlawful or breaches these Terms, or if you hold rights to content that has been posted, report it to support@allfight.app stating:

• the exact location of the content;
• why it is unlawful;
• your contact details;
• a good-faith statement that your report is accurate.

We review every report diligently and objectively, and inform the author of the content of any removal decision, in accordance with Regulation (EU) 2022/2065 on digital services. Abusive reports may engage their author's liability.

11Intellectual property

The Services, their structure, code, design, text, graphics, logos, the AllFight brand and all their elements, except user content and third-party trademarks, are the exclusive property of AllFight or its licensors. They are protected by intellectual property law.

AllFight grants you a personal, non-exclusive, non-transferable, revocable and free right to use the Services, for strictly private and non-commercial use.

Any reproduction, representation, modification, extraction or exploitation, in whole or in part, without prior written permission is prohibited and may constitute infringement.

12Ambassadors and fighters

• Sending an ambassador application or a fighter profile request through the website does not bind AllFight and creates no right to be selected, published or paid. AllFight is free to accept or refuse any request without having to justify its decision.
• Any collaboration, payment or benefit is subject to a separate written agreement. Without such an agreement, no payment is due.
• A fighter requesting a profile guarantees that the information provided is accurate and that they hold the rights to the photos and content sent. They authorize AllFight to publish them in the Services. AllFight may correct, complete, update or remove a profile at any time.
• Ambassadors agree to comply with advertising rules, in particular by clearly disclosing any sponsored content, and to respect AllFight's image and values.

13Third-party services

The Services may include or link to third-party services: Apple or Google sign-in, social networks, organization websites, ticketing or streaming platforms. Their use is subject to their own terms. AllFight has no control over these services and is not responsible for their content, availability or practices.

The app is distributed through the App Store and Google Play. Apple and Google are not parties to these Terms and have no maintenance or support obligation regarding the app.

14Availability and changes to the Services

We do our best to keep the Services available. However, this is only an obligation of means, and access may be interrupted, in particular for maintenance, updates, outages or force majeure.

AllFight may at any time change, modify, limit or remove all or part of the Services' features, or stop providing them, without compensation, provided it informs you within a reasonable time when this significantly affects your use.

The Services are provided "as is" and "as available". To the extent permitted by law, AllFight does not guarantee that they will be error-free, uninterrupted or fit for a particular purpose.

15Limitation of liability

To the extent permitted by applicable law, AllFight cannot be held liable for:

• indirect damage, such as loss of data, opportunity, profit or reputation;
• inaccurate, incomplete or delayed sports information, results or odds;
• decisions you make based on information from the Services, in particular regarding bets placed with third-party operators;
• content posted by users and relationships between users, in particular within leagues;
• rewards promised between league members;
• interruptions, bugs or loss of points;
• third-party services;
• use that does not comply with these Terms, or unauthorized access to your account resulting from a lack of care on your part.

As the Services are provided free of charge, AllFight's total liability, for all causes combined, is limited to the higher of the amounts you actually paid us in the last twelve months and one hundred euros (€100).

Nothing in these Terms excludes or limits AllFight's liability for fraud, intentional or gross misconduct, personal injury, or in any other case where the law prohibits such exclusion. The mandatory rights granted to consumers remain fully applicable.

16Your responsibility

You are responsible for how you use the Services and for the content you post.

You agree to indemnify AllFight, its managers and partners against any damage, costs (including reasonable legal fees) and third-party claims resulting from your breach of these Terms, the law or a third party's rights, to the extent permitted by law.

17Suspension and termination

In the event of a breach of these Terms, AllFight may, depending on the seriousness, remove content, warn the user, cancel points, temporarily suspend or permanently delete the account. Where the law allows, the measure may be taken without notice and without compensation.

Except in an emergency or where required by law, the user is informed of the measure and its reasons, and may contest it by writing to the contact address.

You can stop using the Services at any time by deleting your account.

The sections on intellectual property, limitation of liability, your responsibility and governing law survive termination.

18Changes to the Terms

AllFight may change these Terms at any time, in particular to reflect changes to the Services or to the law.

In the event of a material change, you will be informed through an in-app notification or by email at least 15 days before it takes effect, unless the change is required by law or for security reasons.

Continuing to use the Services after that date means you accept the new Terms. If you refuse them, you can delete your account.

19Force majeure

AllFight cannot be held liable for failing to meet its obligations due to force majeure or an event beyond its control. This includes outages at technical providers, cyberattacks, telecommunications network failures, administrative decisions, natural disasters, epidemics and labor disputes.

20General provisions

• Severability: if a clause of these Terms is held void or unenforceable, it will be replaced by a valid clause as close as possible to the original intent. The other clauses remain in force.
• No waiver: AllFight's failure to enforce a breach does not waive its right to enforce it later.
• Assignment: AllFight may assign these Terms to any entity taking over all or part of the business. You may not assign your rights and obligations without prior written consent.
• Entire agreement: these Terms and the privacy policy form the entire agreement between you and AllFight regarding the Services.
• Language: these Terms are a translation of the French version, which prevails in the event of any discrepancy.
• Evidence: computer records kept in our systems are proof of the exchanges and actions carried out in the Services, unless proven otherwise.

21Governing law and disputes

These Terms are governed by Belgian law.

In the event of a dispute, please contact us first at support@allfight.app to seek an amicable solution. If you are a consumer, you can also turn free of charge to the Belgian Consumer Mediation Service (consumentenombudsman.be).

Failing an amicable agreement, any dispute will fall under the jurisdiction of the competent Belgian courts, without prejudice to the mandatory rules that allow you, as a consumer residing in the European Union, to bring proceedings before the courts of your place of residence and to benefit from the protective provisions of your country's law.
